Vivien is a skilled commercial litigator with broad experience with investigations and claims involving fraud, insolvency, shareholder disputes, unfair prejudice, professional negligence and intellectual property. Many of the disputes Vivien has advised on involve multiple jurisdictions and she is experienced in obtaining freezing injunctions and other urgent interim relief, as well as tracing misappropriated funds through obtaining Bankers Trust orders.
Vivien’s clients have included banks, regulatory bodies, private equity funds, high net worth individuals and multinational corporations.
With a dual degree in law and accounting, Vivien has strong financial analytical skills that are valuable to her insolvency investigation work and when conducting auditors’ negligence proceedings on behalf of liquidators.
Vivien joined Lipman Karas in 2019. She commenced her legal career in Brisbane, Australia, before moving to Hong Kong in 2012 with Fangda Partners.
Minority shareholder of a company
Represented the minority shareholder of a company (which in turn was a shareholder of Asia Television Limited, one of the two free-to-air television stations in Hong Kong at the time) in a high profile court action relating to a shareholder dispute and unfair prejudice claims. Vivien also advised on issues surrounding the winding up proceedings with respect to Asia Television Limited.
Significant private equity firm
Represented a significant private equity firm in a dispute with a former partner for breach of contract, breach of director’s duties, unilateral mistake and misappropriation of business.
One of Asia’s largest residential construction and building materials companies
Represented one of Asia’s largest residential construction and building materials companies in its Hong Kong proceedings against senior management for financial fraud and misappropriation of assets. This involved obtaining interim freezing injunctions in aid of foreign proceedings and the tracing of assets.
Hong Kong public company
Represented a Hong Kong public company with respect to a winding up petition filed by a creditor against it. Advised the company regarding various insolvency issues including the company’s debt restructuring arrangement.
Famous PRC shampoo manufacturer
Represented a famous PRC shampoo manufacturer in a high profile defamation case in Hong Kong against a magazine for the publication of a defamatory article.
